Dear Gordon, Thank you for your email of 6 December 2007. The contents of same have been noted.
I have reviewed our previous offer of 3 October 2007 and remain of the opinion that the offer made by RACQ Insurance was fair and equitable. It is noted in your email that you consider Insurer’s Hotline have caused considerable delays in settlement. This delay was beyond the control of our client, and understandably, as their liability insurers, RACQ Insurance do not consider they are the party responsible for the reimbursement of your client’s excessive costs.
Notwithstanding the above statement, in an effort to demonstrate our willingness to settle the matter in an empathetic manner, I am prepared to make a further offer in the sum of $741.80 to discharge our client’s liability for your client’s hire costs. This offer is based on 14 days hire charges at $52.19 per day, which we consider is generous in the circumstances, given that 15 days elapsed prior to your insurer assessing the subject vehicle, together with $11.80 for travel costs.
The above offer will be the final offer made on behalf of our client, and remains open for acceptance in writing by your client for a period of XXX.
